1. ACCEPTANCE OF TERMS

By booking an appointment, accessing our services, or using our facilities at Rose Beauty Clinic (“the Clinic,” “we,” “us,” or “our”), you (“Client,” “you,” or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not book or use our services.


2. SERVICES PROVIDED

Rose Beauty Clinic is a medically supervised aesthetic clinic located in Thornhill, Ontario, providing the following services:

  • High-Intensity Focused Ultrasound (HIFU)
  • Laser Hair Removal
  • Botox Treatments
  • Hyaluronic Acid (HA) Dermal Fillers
  • Body Contouring
  • Chemical Peels
  • Facial Treatments
  • Mesotherapy
  • Microdermabrasion
  • Acne Treatments
  • Scar Removal
  • Other aesthetic treatments as offered

All services are subject to availability and medical suitability assessment.


3. ELIGIBILITY AND CONSULTATION

3.1 Age Requirements

Clients must be 18 years of age or older to receive treatments. Proof of age may be required.

3.2 Medical Consultation

All clients must undergo a consultation prior to treatment. During consultation, you must:

  • Provide accurate and complete medical history
  • Disclose all medications, supplements, and medical conditions
  • Inform us of any allergies or previous adverse reactions
  • Disclose pregnancy, breastfeeding, or plans to become pregnant

3.3 Medical Contraindications

The Clinic reserves the right to refuse service if you have contraindications including but not limited to:

  • Active infections or skin conditions in treatment area
  • Pregnancy or breastfeeding (for certain treatments)
  • Immunosuppressive conditions
  • Use of certain medications (e.g., blood thinners, photosensitizing drugs)
  • Cancer or active cancer treatment
  • Pacemakers or metal implants (for certain treatments)
  • Other conditions as determined by our medical professionals

4. APPOINTMENTS AND SCHEDULING

4.1 Booking

Appointments can be booked via:

All appointments must be confirmed at least 24 hours in advance. Unconfirmed appointments may be cancelled.

4.3 Cancellation Policy

  • 24-Hour Notice Required: Cancellations or rescheduling must be made at least 24 hours before your scheduled appointment
  • Late Cancellations: Cancellations made less than 24 hours before your appointment may result in a cancellation fee of 50% of the treatment cost
  • No-Shows: Failure to attend your appointment without notice will result in a charge of 100% of the treatment cost
  • Repeated Violations: Multiple late cancellations or no-shows may result in required prepayment for future appointments

4.4 Lateness

Clients arriving more than 15 minutes late may need to reschedule their appointment. The cancellation policy will apply.

4.5 Clinic Cancellations

The Clinic reserves the right to cancel or reschedule appointments due to emergencies, equipment failure, or practitioner unavailability. Reasonable notice will be provided when possible.


5. PRICING AND PAYMENT

5.1 Fees

  • All prices are in Canadian Dollars (CAD)
  • Prices are subject to change without notice
  • Current pricing is available on our website or upon request
  • Custom treatment plans will be quoted during consultation

5.2 Payment Methods

We accept:

  • Cash
  • Credit cards (Visa, MasterCard, American Express)
  • Debit cards
  • E-transfers

5.3 Payment Terms

  • Payment is due at the time of service unless otherwise arranged
  • Package deals and multiple treatment plans must be paid in full or according to agreed payment schedule
  • Outstanding balances must be settled before future appointments will be scheduled

5.4 HST

All prices are subject to applicable Harmonized Sales Tax (HST).

5.5 Refund Policy

  • Prepaid Treatments: Refunds for prepaid services will be considered on a case-by-case basis, minus a 20% administrative fee
  • Package Deals: Package deals are non-refundable after the first treatment has been administered
  • Product Sales: Products are non-refundable once opened
  • Unsatisfactory Results: Results may vary by individual. Refunds are not provided for subjective dissatisfaction with aesthetic outcomes

6. TREATMENT CONSENT AND RISKS

6.1 Informed Consent

By proceeding with treatment, you acknowledge that:

  • You have received adequate information about the treatment
  • You understand the nature and purpose of the treatment
  • You have been informed of potential risks and side effects
  • You have had the opportunity to ask questions
  • You consent to the treatment voluntarily

6.2 Potential Risks

You acknowledge that all medical and aesthetic procedures carry risks, including but not limited to:

  • Redness, swelling, or bruising
  • Pain or discomfort
  • Infection
  • Scarring
  • Hyperpigmentation or hypopigmentation
  • Allergic reactions
  • Burns (for laser treatments)
  • Asymmetry
  • Unsatisfactory aesthetic results
  • Rare serious complications

6.3 Results Disclaimer

  • Results vary by individual and are not guaranteed
  • Multiple treatments may be necessary for desired results
  • Results may be temporary and require maintenance
  • Before and after photos on our website/social media represent individual results and do not guarantee similar outcomes for you

6.4 Photography

We may request to take photographs for medical records. You may grant or deny additional permission for use of images in marketing materials. Any marketing use requires separate written consent.


7. CLIENT RESPONSIBILITIES

7.1 Pre-Treatment

You agree to:

  • Follow all pre-treatment instructions provided
  • Arrive with clean skin free of makeup (for facial treatments)
  • Avoid sun exposure as directed
  • Discontinue certain medications or supplements as advised
  • Inform us of any changes to your health status

7.2 Post-Treatment

You agree to:

  • Follow all aftercare instructions
  • Attend follow-up appointments as recommended
  • Contact us immediately if complications arise
  • Avoid certain activities as directed (e.g., sun exposure, exercise, swimming)
  • Use recommended skincare products

7.3 Honesty

You agree to provide truthful and complete information regarding your medical history, current health status, and adherence to instructions.


8. LIABILITY AND INDEMNIFICATION

8.1 Limitation of Liability

To the fullest extent permitted by law:

  • The Clinic’s liability is limited to the cost of the treatment provided
  • We are not liable for indirect, incidental, consequential, or punitive damages
  • We are not liable for complications arising from failure to follow instructions
  • We are not liable for pre-existing conditions or undisclosed medical issues

8.2 Assumption of Risk

You acknowledge and assume all risks associated with aesthetic treatments, including known and unknown risks.

8.3 Indemnification

You agree to indemnify and hold harmless Rose Beauty Clinic, its owners, employees, and practitioners from any claims, damages, or expenses arising from:

  • Your failure to disclose medical information
  • Your failure to follow pre- or post-treatment instructions
  • Your use of unauthorized products or treatments
  • Any misrepresentation made by you

9. PRIVACY AND CONFIDENTIALITY

9.1 Personal Information

We collect personal and medical information necessary to provide services safely and effectively. This includes:

  • Contact information
  • Medical history
  • Treatment records
  • Payment information
  • Photographs (with consent)

9.2 Privacy Compliance

We comply with applicable Canadian privacy laws including the Personal Information Protection and Electronic Documents Act (PIPEDA) and Ontario privacy legislation.

10.2 Medical Emergencies

In the event of a medical emergency during treatment, we will provide immediate care and, if necessary, arrange emergency medical services. You may be responsible for costs associated with emergency medical care.

10.3 Scope of Practice

Rose Beauty Clinic provides aesthetic services only. We do not diagnose, treat, or cure medical conditions. For medical concerns, please consult your primary care physician.


11. PRODUCTS AND RETAIL SALES

11.1 Product Recommendations

We may recommend skincare products to enhance or maintain treatment results. These recommendations are based on professional assessment but results may vary.

11.2 Product Returns

  • Products are non-refundable once opened
  • Unopened products may be returned within 14 days with receipt
  • Defective products will be exchanged or refunded

11.3 Product Liability

We are not responsible for adverse reactions to recommended products. Conduct a patch test if you have sensitive skin or allergies.


12. INTELLECTUAL PROPERTY

12.1 Ownership

All content on our website, marketing materials, and within our clinic, including but not limited to text, graphics, logos, images, and software, is the property of Rose Beauty Clinic and protected by copyright and trademark laws.

12.2 Restrictions

You may not reproduce, distribute, modify, or create derivative works from our content without written permission.


13. COMMUNICATIONS AND MARKETING

13.1 Appointment Reminders

We may send appointment reminders via phone, email, or text message.

13.2 Marketing Communications

14. GIFT CERTIFICATES AND PROMOTIONS

14.1 Gift Certificates

  • Gift certificates are non-refundable
  • Gift certificates cannot be redeemed for cash
  • Gift certificates must be used within one year of purchase
  • Lost or stolen gift certificates cannot be replaced

14.2 Promotional Offers

  • Promotional offers cannot be combined with other discounts
  • Promotions are subject to terms and conditions as specified
  • The Clinic reserves the right to modify or cancel promotions at any time

15. CONDUCT AND FACILITY RULES

15.1 Respectful Behavior

Clients are expected to treat staff and other clients with respect. We reserve the right to refuse service to anyone who:

  • Is abusive, threatening, or disrespectful
  • Is under the influence of alcohol or drugs
  • Violates clinic policies
  • Disrupts clinic operations

15.2 Hygiene

For the safety of all clients and staff, please maintain good personal hygiene when visiting the clinic.

15.3 Children

For safety and comfort, we ask that children do not accompany clients to appointments unless they are also receiving services.

15.4 Mobile Devices

Please silence mobile devices during treatments. Use of devices may be restricted in treatment areas.


16. DISPUTE RESOLUTION

16.1 Concerns and Complaints

If you have concerns about your treatment or experience:

  2. We will investigate and respond within 5 business days
  3. We will work with you to resolve the issue fairly

16.2 Governing Law

These Terms and Conditions are governed by the laws of Ontario and Canada. Any disputes will be subject to the exclusive jurisdiction of the courts of Ontario.

16.3 Arbitration

Prior to initiating legal action, both parties agree to attempt to resolve disputes through mediation or arbitration.


17. MODIFICATIONS TO TERMS

17.1 Right to Modify

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to our website or clinic premises.

17.2 Notification

Material changes will be communicated via email or notice at the clinic. Your continued use of our services after changes constitutes acceptance of the modified terms.

18. SEVERABILITY

These Terms and Conditions, together with any consent forms and treatment agreements you sign, constitute the entire agreement between you and Rose Beauty Clinic regarding the subject matter herein.
